Notary Wisely
Provider Agreement
This agreement establishes the baseline rules for notaries and other independent service providers applying to, listed on, or accepting assignments through Notary Wisely.
Last updated: October 3, 2026
1. Acceptance and authority
By submitting a provider or notary application, maintaining a provider profile, or accepting an assignment, you agree to this Provider Agreement, the Terms of Service, the Privacy Policy, and service-specific requirements shown before acceptance. If you act for a business, you represent that you are authorized to bind it and that every person performing services will follow these requirements.
2. Independent provider relationship
Providers are independent businesses or professionals and are not employees, agents, partners, franchisees, or legal representatives of Notary Wisely. You control whether to accept an offered assignment and remain responsible for your methods, equipment, transportation, insurance, taxes, licenses, and professional judgment, subject to the customer's instructions and applicable law.
Application, approval, directory placement, training, or account access does not guarantee assignments, minimum earnings, exclusivity, coverage volume, or continued eligibility.
3. Credentials and continuing eligibility
You must provide accurate, current, and complete identity, commission, license, registration, insurance, training, background-check, and business information when required. You must promptly report expiration, suspension, restriction, discipline, criminal charge or conviction relevant to the work, loss of insurance, safety concern, or other material change.
Notary Wisely may verify information, request updated records, limit eligible services, pause assignments, remove a listing, or suspend access while a review is pending. Account creation and application submission do not equal approval or assignment eligibility.
4. Lawful scope and professional judgment
You may perform only services you are legally and professionally qualified to provide in the applicable location. Notaries must remain impartial, identify the required signer and notarial act without choosing it for the customer, maintain any required journal, use seals and certificates lawfully, and refuse an act when identification, willingness, awareness, document completeness, conflict, coercion, fraud, or law requires refusal.
Unless separately licensed and authorized, you may not provide legal, immigration, tax, financial, real-estate, or other regulated advice; select or draft legal instruments; guarantee government acceptance; misrepresent an administrative service as legal representation; or use a notary commission to imply authority beyond the law.
5. Assignment procedure
- An assignment offer is not accepted until the platform records your acceptance or a coordinator confirms it.
- Review the scope, location, timing, compensation, documents, qualifications, and disclosed fees before accepting.
- Do not transfer, subcontract, or send another person without written platform authorization and verification of that person.
- Communicate promptly, arrive as confirmed, follow lawful instructions, record required status updates, and submit accurate completion or noncompletion evidence.
- Do not mark work complete before it is complete, falsify time or location, alter documents without authority, or conceal a failed or refused service.
- Report delays, conflicts, safety issues, suspected fraud, customer complaints, or inability to complete as soon as reasonably possible.
6. Customer care, safety, and nondiscrimination
Provide respectful, professional, accessible, and nondiscriminatory service. Do not harass, threaten, retaliate, solicit improper payments, carry out unsafe instructions, or exploit a customer's disability, age, language, immigration status, financial condition, or lack of legal knowledge. Leave an unsafe location and contact emergency services when appropriate, then notify Notary Wisely when safe.
7. Privacy and document security
Use customer and enterprise information only to complete the authorized assignment. Limit access to people with an approved operational need. Protect documents, identification details, access codes, messages, photos, and addresses from loss or disclosure. Do not copy, retain, post, sell, train an artificial-intelligence system on, or market to customer data except as required for the service or law.
Use approved platform channels and secure upload methods when available. Promptly report misdirected information, device loss, unauthorized access, or suspected breach. Follow return, deletion, retention, and chain-of-custody instructions.
8. Compensation, expenses, and taxes
Assignment-specific compensation and material deductions must be displayed or otherwise agreed before acceptance. You are responsible for reviewing the offer and for your ordinary business expenses unless the offer expressly states otherwise. Payment may depend on verified completion, required records, cancellation rules, refunds, disputes, chargebacks, legal holds, and payout onboarding.
You are responsible for taxes and required filings arising from provider earnings. Do not collect undisclosed amounts, move an assigned transaction off-platform to avoid fees or records, or charge a customer differently from the confirmed terms without authorization.
9. Records, quality review, and cooperation
Maintain legally required records and preserve platform evidence reasonably needed for payment, audit, complaint, credential, safety, and dispute review. Cooperate with reasonable investigations and provide truthful information. Notary Wisely may review communications, status events, documents, customer reports, and service evidence within applicable privacy and legal limits.
10. Suspension, removal, and review
Notary Wisely may restrict offers, pause payouts where legally permitted, remove directory visibility, suspend services, or terminate provider access for expired or false credentials, safety risk, fraud, misconduct, repeated nonperformance, privacy breach, unlawful activity, payment abuse, or material policy violation. When appropriate, the provider will receive notice and a way to submit relevant information for review.
11. Changes and service-specific rules
State, customer, enterprise, government, and service-specific requirements may add to this Agreement. The provider must follow the strictest applicable lawful requirement. Material updates will receive a new version or effective date and may require renewed acceptance before future assignments.
12. Questions and notices
Questions, complaints, safety reports, and provider notices may be submitted through Support, emailed to support@notarywisely.com, or mailed to Notary Wisely LLC, 312 Superior Mall, Port Huron, MI 48060.
